Miranda Calderón Abogados is a law firm based in Mendoza, Argentina. We advise companies, their in house counsel and their foreign advisers on the employment and regulatory obligations that apply when operating in this country.

Why firms come to us

Most of our practice is litigation. We represent claimants in workplace accident, occupational illness, harassment and discriminatory dismissal proceedings, and we do it every week before the labour courts of Mendoza.

That gives our compliance advice something a purely advisory practice cannot offer. We do not tell you what the statute says in the abstract. We tell you which clauses, which records and which omissions actually produce liability in this jurisdiction, because we are the ones who bring those claims and we see which ones succeed.

For that reason our advisory work is preventive. We help organisations meet their obligations and reduce exposure before a dispute exists. We do not act for employers in litigation, which keeps our advice free of the conflict that would otherwise arise.

Harassment and discrimination prevention

Internal reporting channels, investigation protocols, protection of pregnancy and parental leave, and the evidentiary standards Argentine courts apply to discrimination claims, which shift the burden of proof in ways that surprise companies used to other systems.

Personal data protection

Compliance with Law 25.326 on the Protection of Personal Data, registration of databases with the Agency for Access to Public Information, employee data handling, and international transfer requirements.

Working with us from abroad

We work regularly with counsel and advisers outside Argentina. Meetings are held remotely, correspondence is in English, and we are used to producing the kind of written analysis that a parent company or an external adviser needs in order to make a decision.

Mendoza is the centre of Argentine wine production and a significant agricultural, mining services and energy region, so a good part of our work involves operations with foreign ownership or foreign counterparties.
